Terms and Conditions of Sale

Last updated: [DATE OF LAST UPDATE]

These Terms and Conditions of Sale govern purchases made through the online store available at
piscispro.eu, operated under the trade name PiscisPro.

By placing an order, the customer confirms that they have read and accepted these Terms and Conditions before
completing the purchase.

  • NIF, CIF or NIE: [NIF/CIF/NIE]
  • Registered or tax address: [FULL ADDRESS]

2. Scope

These Terms apply to the sale of kits, moulds, materials and related products for making soft plastic fishing
lures through PiscisPro.

They apply to consumers purchasing from Spain and other countries of the European Union, without prejudice to any
mandatory consumer-protection rules applicable in the customer’s country of residence.

3. Customer eligibility

Customers must have the legal capacity required to enter into a purchase contract.

By placing an order, the customer confirms that the information provided during checkout is accurate, complete and
up to date.

4. Product information

PiscisPro aims to provide accurate descriptions, images, dimensions, contents and technical information for each
product.

Product colours, finishes and appearance may vary slightly due to manufacturing tolerances, raw materials, lighting
or screen settings.

The customer should review all product information, warnings and instructions before use.

5. Product availability

Products are offered subject to availability.

If a product becomes unavailable after an order has been placed, PiscisPro will inform the customer and offer an
appropriate solution, such as:

  • A full refund.
  • A replacement product, subject to the customer’s express agreement.
  • A revised delivery date, subject to the customer’s express agreement.

6. Ordering process

The usual ordering process is:

  1. Select the product and quantity.
  2. Add the product to the shopping cart.
  3. Review the cart and applicable charges.
  4. Enter billing, delivery and contact details.
  5. Select a payment and delivery method.
  6. Review the order summary.
  7. Accept the applicable legal terms.
  8. Confirm the order with an action that clearly indicates an obligation to pay.

Before confirming the order, the customer may review and correct the information entered.

7. Formation of the contract

The customer’s submission of an order constitutes an offer to purchase.

The contract is formed when PiscisPro sends an order confirmation or otherwise expressly accepts the order.

An automated acknowledgement confirming receipt of an order does not necessarily constitute final acceptance where
availability, payment or fraud checks are still pending.

Electronic contracts are legally valid where the necessary consent and contractual requirements are present.

8. Prices

Prices are displayed in [CURRENCY] and [INCLUDE / EXCLUDE] applicable taxes.

The final amount payable, including taxes, delivery costs and any other applicable charges, will be displayed before
the order is confirmed.

PiscisPro may change prices at any time. Price changes will not normally affect orders already accepted.

If a product is displayed with an obvious pricing or technical error, PiscisPro may cancel the affected order before
dispatch.

The customer will be informed and any amount already paid will be refunded using the original payment method where
possible.

10. Payment methods

Available payment methods are:

  • [PAYMENT METHOD 1]

Payments may be processed by [PAYMENT PROVIDER].

Where payment is handled by an external payment provider, PiscisPro does not receive or store complete card details.

The order may be suspended or cancelled if payment is rejected, reversed, incomplete or identified as potentially
fraudulent.

11. Invoicing

The customer is responsible for providing correct billing and tax information.

Invoices will be issued in accordance with applicable Spanish tax and accounting requirements.

[CONFIRM WHETHER INVOICES ARE SENT ELECTRONICALLY, AVAILABLE IN THE CUSTOMER ACCOUNT OR PROVIDED ON REQUEST.]

12. Delivery area

PiscisPro currently delivers to:

  • [DELIVERY AREA: SPAIN]
  • [OTHER EU COUNTRIES, IF APPLICABLE]
  • [EXCLUDED REGIONS OR TERRITORIES, IF APPLICABLE]

Orders placed for an unsupported delivery destination may be cancelled and refunded.

13. Delivery costs

Delivery costs depend on the destination, order value, package size, weight and selected delivery method.

The applicable delivery cost will be displayed before the customer confirms the order.

Any customs duties, import taxes or local charges applicable outside the relevant tax territory must be clearly
explained before publication of these Terms.

14. Delivery times

Estimated delivery times are:

  • Spain: [ESTIMATED DELIVERY TIME]
  • Other EU destinations: [ESTIMATED DELIVERY TIME]

Delivery estimates begin after payment confirmation and order preparation.

Unless another period has been agreed, goods should be delivered within the period required by applicable consumer
law.

Delivery times may be affected by weekends, public holidays, transport disruptions, incorrect addresses or events
outside PiscisPro’s reasonable control.

15. Delivery and risk

The risk of loss or damage generally passes to the consumer when the consumer, or a third party indicated by the
consumer other than the carrier, takes physical possession of the goods.

The customer should inspect the package on delivery and notify PiscisPro promptly of visible damage, missing items
or delivery incidents.

16. Incorrect delivery details

The customer is responsible for providing a complete and accurate delivery address.

Additional costs caused by incorrect or incomplete information may be charged to the customer where legally
permitted and where the customer was properly informed.

17. Right of withdrawal

Subject to the legal exceptions, a consumer may withdraw from an online purchase within
14 calendar days without giving a reason. For goods, the period generally begins when the consumer
or a third party designated by the consumer receives physical possession of the goods.

Where several goods from one order are delivered separately, the withdrawal period generally begins when the final
item is received.

The notice may be sent to:

functioning.

The customer may be responsible for diminished value resulting from handling beyond what is necessary for that
purpose.

20. Return shipping costs

[SELECT AND COMPLETE ONE OPTION BEFORE PUBLICATION.]

Option A: The customer bears the direct cost of returning goods after exercising the right of withdrawal, unless the
goods are defective, incorrect or damaged.

21. Refunds following withdrawal

Where the right of withdrawal is validly exercised, PiscisPro will refund the payments required by law, including
the cost of the least expensive standard delivery option offered for the original order.

Additional delivery costs resulting from the customer choosing a more expensive delivery method may not be
refundable.

The refund may be withheld until PiscisPro receives the returned goods or the customer provides sufficient evidence
that the goods have been returned, where legally permitted.

Refunds will normally be made using the original payment method unless another method is expressly agreed.

22. Exceptions to the right of withdrawal

The right of withdrawal may not apply in the cases established by law.

Possible exceptions may include:

  • Goods made to the customer’s specifications or clearly personalised.
  • Sealed goods not suitable for return for health or hygiene reasons once unsealed.
  • Goods that, after delivery, become inseparably mixed with other items.
  • Other legally recognised exceptions.

An exception must not be applied unless the product and circumstances genuinely meet the legal conditions.

23. Damaged, defective or incorrect products

If a product is damaged, defective, incomplete or different from what was ordered, the customer should contact
PiscisPro at [CUSTOMER SERVICE EMAIL].

The customer should provide:

  • Order number.
  • Description of the issue.
  • Photographs or video where reasonably necessary.
  • Information about the packaging and delivery condition.

Where the product does not conform to the contract, the customer may be entitled to repair, replacement, price
reduction or termination of the contract in accordance with applicable law.

24. Legal guarantee

Products sold to consumers are covered by the mandatory legal guarantee applicable in Spain and the European Union.

The legal guarantee is separate from any optional commercial guarantee offered by PiscisPro or a manufacturer.

These Terms do not restrict any mandatory consumer rights relating to defective or non-conforming goods.

25. Product use and safety

The customer must follow all instructions, warnings and safety information supplied with the product.

Products and materials used to make soft plastic fishing lures may involve heat, liquid materials, pigments, tools
or equipment that require appropriate ventilation, protective equipment and adult supervision.

[INSERT VERIFIED PRODUCT-SPECIFIC SAFETY INFORMATION, AGE RESTRICTIONS AND MATERIAL WARNINGS.]

PiscisPro is not responsible for damage caused by use contrary to instructions, improper modification, unsafe
handling or use outside the intended purpose, except where liability cannot legally be excluded.

Where customer accounts are enabled, users are responsible for keeping their access credentials confidential.

PiscisPro may suspend accounts used fraudulently, unlawfully or in breach of these Terms.

27. Promotions and discount codes

Promotions and discount codes may be subject to specific conditions, validity periods, minimum order values and
product exclusions.

Unless otherwise stated, promotions cannot be combined and cannot be exchanged for cash.

28. Intellectual property

Product images, texts, videos, designs, branding and website content are protected by intellectual and industrial
property rights.

Purchasing a product does not grant the customer any right to reproduce or commercially exploit PiscisPro’s protected
content or branding.

29. Personal data

Personal data is processed in accordance with the PiscisPro Privacy Policy.

Cookies and similar technologies are described in the Cookie Policy.

30. Liability

PiscisPro is responsible for fulfilling its obligations under the purchase contract and applicable consumer law.

PiscisPro is not responsible for losses caused exclusively by:

  • Incorrect information provided by the customer.
  • Improper use of the products.
  • Failure to follow product instructions or safety warnings.
  • Events outside its reasonable control.
  • Third-party services outside PiscisPro’s control.

Nothing in these Terms excludes or limits liability that cannot legally be excluded.

31. Force majeure

PiscisPro will not be liable for delays or failure caused by events outside its reasonable control, including natural
disasters, transport interruptions, strikes, government actions, telecommunications failures or major supplier
disruptions.

PiscisPro will take reasonable steps to minimise the effects and inform affected customers.

32. Complaints

Customers may submit complaints through:

  • Email: [CUSTOMER SERVICE EMAIL]
  • Telephone: [TELEPHONE]
  • Postal address: [FULL ADDRESS]

PiscisPro will review complaints within a reasonable period and provide the customer with relevant information about

[CONFIRM WHETHER THE BUSINESS PARTICIPATES IN A CONSUMER ARBITRATION OR OTHER ALTERNATIVE DISPUTE-RESOLUTION SYSTEM.]

This section must be updated with the competent consumer body or dispute-resolution entity where applicable.

34. Applicable law and jurisdiction

These Terms are governed by Spanish law, without prejudice to mandatory consumer-protection rules applicable in the
customer’s country of residence.

Disputes will be submitted to the courts determined by mandatory procedural and consumer-protection legislation.

No clause in these Terms requires a consumer to submit to a jurisdiction different from that established by
mandatory law.

35. Changes to these Terms

PiscisPro may update these Terms to reflect changes in products, delivery methods, payment methods, business
operations or legal requirements.

The Terms accepted when an order is placed will normally govern that order.
